General terms and conditions Skin Project
We apply the following general terms and conditions.
- General
1.1 In these terms, 'skin therapist' refers to the skin therapist(s) registered under article 34 BIG, all employees of Skin Project Huidtherapie located at Albert Cuypstraat 233-H, 1073 BG in Amsterdam. The skin therapists are members of the Dutch Association of Skin Therapists (NVH) and work in accordance with the professional code of the NVH. The skin therapists are also registered in the Dutch Quality Register for Paramedics.
1.2 In these terms, 'client' refers to the person who instructs the skin therapist to perform treatment.
1.3 In these terms, 'client' also refers to their legal representative.
1.4 These terms are part of every agreement between the client and the skin therapist.
1.5 These terms also apply in the event that the skin therapist involves third parties in the execution of the assignment.
1.6 A medical treatment agreement (ex Book 7, title 7, section 5 of the Civil Code) between the skin therapist and the client is also subject to the Medical Treatment Agreement Act (WGBO).
1.7 The operation of Article 7:404 and Article 7:407 paragraph 2 of the Civil Code is expressly excluded.
- Agreement
2.1 The agreement between the skin therapist and the client encompasses the client's assignment to the skin therapist for medical or non-medical treatment.
2.2 The skin therapist is entitled to refuse an unreasonable request from the client and may decline to perform a treatment.
3.Consent
3.1 The client grants consent to the skin therapist prior to the execution of the treatment.
3.2 The skin therapist may require the client to confirm their consent in writing.
3.3 The client's consent also includes the authority of the skin therapist to engage assistants and to accept any liability limitations of assistants on behalf of the patient. The skin therapist is not liable for the choice of the assistant and for any shortcomings of this assistant, except in cases of intent or gross negligence by the skin therapist.
3.4 If the client refuses or withdraws consent, the skin therapist will not perform any further treatment.
3.5 In the case of a minor (under 18 years), the parent/guardian/legal representative must provide written consent before the first treatment begins.
- Information and documentation
4.1 The client must inform and keep the skin therapist updated on all information necessary for the proper execution of the agreement.
- Rates and health insurance
5.1 During the intake conversation, a price agreement is made for the treatment. This includes the area to be treated and the duration.
5.2 Skin Project offers the intake conversation free of charge for the first time.
5.3 The agreed price applies per treatment or is valid for a package or course price.
5.4 The skin therapist reserves the right to deviate from the agreed price if the duration or the area to be treated is changed. This will be discussed with the client prior to the treatment.
5.5 Rates apply, unless expressly stated otherwise in a written agreement, for the duration of the calendar year and may be adjusted annually.
5.6 The client is responsible for being aware of whether and to what extent their insurer reimburses the treatment. Furthermore, it is the client's responsibility to declare invoices to their insurer or not.
- Payment
6.1 The client receives the invoice immediately after the treatment and must pay it in cash or by card payment at that time.
6.2 Regardless of whether the invoice is reimbursed by the insurer, the client is at all times obliged to make full and timely payment of the invoice.
6.3 The client is responsible for submitting and handling invoices with health insurers. Skin Project is not responsible for changes in rights regarding reimbursements and policy conditions. In case of questions, the client should contact the health insurer.
6.4 In the event that the client does not pay the invoice on time and/or in full, they are in default. The skin therapist is then entitled to charge statutory interest on the invoice amount, or the remaining amount, to the client. The skin therapist is also authorized to take collection measures. The costs associated with the collection (including extrajudicial costs and other costs) are the responsibility of the client.
6.5 In case of payment arrears, the skin therapist is authorized to suspend further treatment or to only provide it against cash payment, unless the amount of the payment arrears, the necessity for skin therapeutic treatment, or the urgency opposes this.
6.6 The payment obligation is not suspended because the client files a complaint against the skin therapist regarding the invoice and/or the treatment, unless the skin therapist agrees to suspend the payment obligation.
6.7 The payment obligation does not cease if the client terminates the agreement or the skin therapist requests to transfer the treatment to another.
- Cancellation
7.1 In the event that the client is unable to attend an appointment, they must cancel this at least 48 hours in advance with the skin therapist.
7.2 If the client does not cancel or does not do so in time within 48 hours, Skin Project is obliged to charge 100 euros in cancellation fees. The health insurer does not reimburse this invoice.
7.3 Appointments can be canceled by the client and/or contact person by phone or by email (only via info@skinproject.nl). The cancellation is registered by Skin Project at the moment the client calls or the email is received by the skin therapist (see also the contact details on www.skinproject.nl).
- Liability
8.1 The liability of Skin Project, both for direct and consequential damage and to the extent covered by its liability insurance, is limited to the amount paid out by the insurer.
8.2 If the insurer does not make a payment in any case, or if the damage is not covered by insurance, the liability of Skin Project is limited to the amount of the invoice.
8.3 Rights to compensation for liability expire after 1 year from the occurrence of the damaging event.
8.4 Skin Project is not responsible for damage resulting from incomplete and/or untruthful information regarding the general health of the client concerning circumstances that may affect the treatment.
8.5 Skin Project cannot predict exactly how many treatments someone needs and cannot be held liable for this. The skin therapists of Skin Project can only indicate the average number of treatments.
8.6 If a (laser) treatment does not succeed or if the condition (such as excessive hair growth and rosacea) returns over time, Skin Project is not responsible or liable for this. Skin Project does not provide guarantees for a treatment.
- Complaints
9.1 In case of dissatisfaction or a complaint from the client regarding the treatment by the skin therapist, the client should report this to Skin Project as soon as possible. The skin therapist and the client will then both make an effort to reach a solution.
9.2 As a member of the NVH, Skin Project receives support from the mandatory complaints officer in case of a complaint and is affiliated with a dispute resolution scheme.
9.3 If a solution proves impossible, the client can turn to the internal complaints committee of the Dutch Association of Skin Therapists: the Patient Advisory Committee (‘PAC’). This committee will mediate between the skin therapist and the client.
9.4 If mediation by the PAC does not lead to a solution, the client can turn to the National Complaints Committee for Paramedics in Primary Care.
- Nullity
In the event that any provision of these terms is null and void or voidable, this does not affect the validity of the other provisions.
- Applicable law
The agreement between the skin therapist and the client, and any further agreements made in execution thereof, are exclusively governed by Dutch law.
- Changes
12.1 The skin therapist reserves the right to change these terms at any time.
